Tornado Cash developers on trial, judge prohibits citing smart contracts case law
According to reports, Judge Katherine Polk Failla of the U.S. District Court for the Southern District of New York ruled that the Van Loon v. Treasury case decision cannot be mentioned in the criminal trial of Tornado Cash developer Roman Storm. The case previously determined that "immutable smart contracts do not constitute property." Storm is charged with Money Laundering, evading sanctions, and other offenses, and if convicted, he faces a maximum of 45 years in prison.
The judge believes that this case is unrelated to criminal cases and may confuse the jury. This case will test whether developers should be held criminally responsible for the way code is used, with the trial scheduled to take place on July 14 in Manhattan.
